Terms of sale and use

1. Seller

erwittradio.com is operated by Erwitt di Giacomo Favilla, Via Roma 130, 57126 Livorno, Italy, VAT 01907930497. Email: info@erwittradio.com; phone/WhatsApp: +39 351 900 8957. These terms govern purchases and use of the store. Mandatory consumer rights always remain applicable.

2. Products, services and orders

Product features, vintage condition, availability, prices and service scope are described on the relevant pages. Particular characteristics of vintage pieces are stated in their descriptions. Work on customers' radios and other requested services is governed by the scope, price and timing of the quotation accepted before work starts.

You must have legal capacity to contract and provide accurate information. Check and correct items, quantities, delivery details and payment before submitting an order. Submitting the final order creates an obligation to pay the displayed total and concludes the contract. We send email confirmation; keep it and a copy of the applicable terms. If an item becomes unavailable, we will contact you promptly and refund the unfulfilled purchase. Substitution requires your agreement.

3. Prices, payment and delivery

Currency, applicable taxes, shipping charges and total are displayed before submission. Payment methods are those offered at checkout and are handled by the relevant providers. Any applicable import duties or charges not included are disclosed before purchase where applicable. No additional charge is made without the consent required by law.

Destinations, costs and timing appear in the shipping policy, product information and checkout. Unless another period is agreed, consumer orders are delivered without undue delay and within thirty days of contract conclusion. Contact us about delays so we can apply the remedies required by law. Risk passes when you or your nominated third party, other than the carrier, physically receive the goods, subject to statutory exceptions. Reporting damage promptly helps us assist you, but failure to report immediately does not remove legal rights.

4. Withdrawal, returns and refunds

For distance purchases, consumers have a statutory right to withdraw without a reason within fourteen days of receiving goods, or of contract conclusion for services. Send a clear statement to info@erwittradio.com or our postal address. The optional form below may be used.

Return goods without undue delay and within fourteen days of notifying withdrawal. We refund the price and standard initial delivery cost, excluding supplements for a more expensive delivery option you selected. Refunds are made within fourteen days of notification using the original payment method unless another fee-free method is agreed. For goods, we may wait until receipt or evidence of dispatch, whichever comes first. You are responsible only for diminished value caused by handling beyond what is necessary to establish nature, characteristics and functioning. Original packaging helps protect the goods but its absence does not automatically remove statutory withdrawal rights.

The store's more favourable commercial benefits remain available: thirty-day returns and free replacement under our returns policy, and any free returns advertised for your purchase. Commercial return conditions do not restrict statutory withdrawal. Contact us before shipping for instructions and any return label.

Withdrawal exceptions apply only where legally permitted and disclosed before purchase, for example clearly personalised or made-to-specification goods. Starting a service during the withdrawal period requires the consumer's express request; any payment due after withdrawal is proportionate to the work performed. Loss of withdrawal rights following full performance requires the conditions and acknowledgements prescribed by law.

5. Guarantees

Consumers benefit from the statutory conformity guarantee, normally two years from delivery, and the remedies provided by applicable law, including free repair or replacement and, where the legal conditions are met, price reduction or contract termination. Contact info@erwittradio.com with the order and problem. Vintage status does not eliminate applicable protection; any particular characteristics must be clearly disclosed.

Radios also benefit from the store's existing five-year commercial guarantee for manufacturing defects or operating problems, with assistance, repair or replacement as described in the guarantee and returns policy. This is additional to statutory rights.

6. Website use

Use the website lawfully, without compromising security or other people's rights. Protect account credentials and report unauthorised access. Text, images, trademarks and other content belong to their respective owners and require permission for reuse where prescribed by law. External services have their own terms and privacy notices. Nothing here excludes liability or rights that cannot lawfully be excluded.

7. Shopify and privacy

Shopify supplies the store platform. Erwitt di Giacomo Favilla is the seller and your contact for orders, returns and support. We use Shopify Network Intelligence: Shopify may combine interactions with this store with information from other stores and services to provide enhanced features, improve experiences and support analytics and advertising, subject to applicable privacy choices. 8. Complaints, applicable law and changes

Email info@erwittradio.com with the issue and order number; we will respond within two days of receipt. We seek an amicable solution without restricting your right to approach competent authorities, dispute resolution bodies or courts. Italian law applies, without excluding more favourable mandatory protection in a consumer's country of habitual residence. Consumer jurisdiction is determined by the rules protecting consumers.

Changes apply to purchases after publication. Existing orders remain governed by the version applicable when purchased. Invalidity of one provision does not invalidate other valid provisions.
